Sponti — Nutzungsbedingungen

Diese Bedingungen sind der Vertrag zwischen dir und dem Entwickler von Sponti. Mit der Nutzung der App stimmst du ihnen zu. Wenn du nicht einverstanden bist, benutze Sponti bitte nicht.

1. Wer Sponti benutzen darf

Du musst mindestens 13 Jahre alt sein. Bist du zwischen 13 und 16, brauchst du je nach Land die Zustimmung eines Elternteils oder Erziehungsberechtigten. Du darfst Sponti nicht benutzen, wenn dein Konto zuvor gesperrt wurde.

2. Dein Konto

Dein Konto ist an deine Telefonnummer gebunden und gehört dir persönlich. Halte den Zugang zu deiner Nummer sicher — wer die SMS empfangen kann, kann sich anmelden. Gib bei der Anmeldung zutreffende Angaben an und gib dich nicht als jemand anderes aus.

3. Deine Inhalte

Pläne, Nachrichten und Fotos, die du erstellst, gehören dir. Damit Sponti funktioniert, gibst du uns das Recht, diese Inhalte zu speichern und den Personen anzuzeigen, mit denen du sie teilst. Dieses Recht endet, wenn du die Inhalte oder dein Konto löschst — mit der Einschränkung, dass Nachrichten in einem Chat für die anderen Teilnehmenden sichtbar bleiben, weil sie Teil deren Unterhaltung sind.

Du bist dafür verantwortlich, dass du die Rechte an dem hast, was du hochlädst.

4. Null Toleranz für anstössige Inhalte und missbräuchliches Verhalten

Sponti duldet keine anstössigen Inhalte und kein missbräuchliches Verhalten. Verboten ist insbesondere:

Sexuelle Darstellungen von Minderjährigen — in jeder Form, ausnahmslos
Belästigung, Mobbing, Drohungen, Stalking oder Hassrede gegen Personen oder Gruppen
Gewaltverherrlichung, Aufrufe zu Gewalt oder Selbstverletzung
Sexuell explizite oder pornografische Inhalte
Illegale Aktivitäten, etwa der Handel mit Drogen oder Waffen
Betrug, Spam, Werbung oder Kettenbriefe
Das Veröffentlichen fremder persönlicher Daten ohne Einwilligung
Vortäuschen einer fremden Identität

In der App kannst du jeden Plan melden und jede Person blockieren. Gemeldete Inhalte werden automatisch ausgeblendet, sobald mehrere Personen sie melden, und wir prüfen Meldungen innerhalb von 24 Stunden. Wer gegen diese Regeln verstösst, verliert Inhalte und kann dauerhaft gesperrt werden — ohne Vorankündigung.

5. Was du nicht tun darfst

Die App oder ihre Server angreifen, überlasten oder umgehen
Daten anderer Nutzerinnen und Nutzer automatisiert auslesen oder sammeln
Die App zurückentwickeln, ausser soweit das Gesetz es erlaubt
Sponti für kommerzielle Massenkommunikation benutzen

6. Treffen finden in der echten Welt statt

Sponti hilft beim Verabreden, veranstaltet aber nichts und überprüft niemanden. Wen du triffst, wo und unter welchen Umständen, entscheidest du selbst, auf eigenes Risiko. Sei vorsichtig, besonders bei Menschen, die du noch nicht kennst.

7. Verfügbarkeit, Gewährleistung, Haftung

Sponti wird „wie besehen“ bereitgestellt. Wir versprechen keine ununterbrochene Verfügbarkeit und keine Fehlerfreiheit, und wir können die App jederzeit ändern oder einstellen. Soweit gesetzlich zulässig, haften wir nicht für indirekte Schäden oder Datenverluste. Zwingende Verbraucherrechte bleiben davon unberührt.

8. Beendigung

Du kannst dein Konto jederzeit in der App löschen (Profil → Konto löschen). Wir können deinen Zugang sperren, wenn du gegen diese Bedingungen verstösst.

9. Anwendbares Recht

Es gilt Schweizer Recht, unter Ausschluss der Kollisionsnormen. Wenn du Verbraucherin oder Verbraucher bist, bleiben die zwingenden Vorschriften deines Wohnsitzlandes anwendbar.

10. Zusätzliche Bestimmungen für Apple-Geräte

Für die iOS-Version gilt ergänzend:

Dieser Vertrag besteht zwischen dir und dem Entwickler, nicht mit Apple. Der Entwickler allein ist für Sponti und dessen Inhalte verantwortlich.
Du erhältst eine nicht übertragbare Lizenz zur Nutzung auf Apple-Geräten, die du besitzt oder kontrollierst, im Rahmen der Nutzungsregeln der App Store-Bedingungen.
Apple ist nicht zu Wartung oder Support verpflichtet.
Sollte die App einer zugesagten Gewährleistung nicht entsprechen, kannst du Apple informieren; Apple erstattet dann gegebenenfalls den Kaufpreis. Darüber hinaus trifft Apple keine Gewährleistungspflicht — für alle weiteren Ansprüche ist der Entwickler zuständig.
Für Ansprüche wegen Produkthaftung, Verstössen gegen Vorschriften, Verbraucherschutz oder Datenschutz sowie wegen Verletzung von Schutzrechten Dritter ist der Entwickler zuständig, nicht Apple.
Du sicherst zu, dich nicht in einem Land mit US-Embargo zu befinden und nicht auf einer Liste verbotener Parteien der US-Regierung zu stehen.
Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen und können sie dir gegenüber durchsetzen.

11. Änderungen

Wir können diese Bedingungen anpassen. Wesentliche Änderungen erkennst du am Datum oben auf dieser Seite; die weitere Nutzung gilt als Zustimmung.

Sponti — Terms of Use

These terms are the agreement between you and the developer of Sponti. By using the app you accept them. If you do not agree, please do not use Sponti.

1. Who may use Sponti

You must be at least 13 years old. If you are between 13 and 16, you may need a parent's or guardian's consent depending on your country. You may not use Sponti if your account was previously banned.

2. Your account

Your account is tied to your phone number and is personal to you. Keep access to that number safe — whoever can receive the SMS can sign in. Give accurate details when you sign up, and do not impersonate anyone.

3. Your content

Plans, messages and photos you create are yours. So that Sponti can work, you give us the right to store that content and show it to the people you share it with. That right ends when you delete the content or your account — with the limit that messages in a chat remain visible to the other participants, because they are part of their conversation.

You are responsible for having the rights to whatever you upload.

4. Zero tolerance for objectionable content and abusive behaviour

Sponti does not tolerate objectionable content or abusive users. The following is prohibited:

Sexual content involving minors — in any form, without exception
Harassment, bullying, threats, stalking, or hate speech against people or groups
Glorifying violence, or encouraging violence or self-harm
Sexually explicit or pornographic content
Illegal activity, such as trading in drugs or weapons
Fraud, spam, advertising, or chain messages
Posting someone else's personal information without their consent
Impersonating another person

In the app you can report any plan and block any person. Reported content is hidden automatically once several people report it, and we review reports within 24 hours. Anyone who breaks these rules loses the content and may be permanently banned, without notice.

5. What you must not do

Attack, overload or circumvent the app or its servers
Scrape or harvest other users' data
Reverse engineer the app, except as the law permits
Use Sponti for bulk commercial messaging

6. Meetings happen in the real world

Sponti helps you arrange to meet; it does not host events and does not vet anyone. Who you meet, where, and on what terms is your decision and your risk. Be careful, especially with people you do not already know.

7. Availability, warranty, liability

Sponti is provided "as is". We do not promise uninterrupted availability or freedom from errors, and we may change or discontinue the app at any time. To the extent the law allows, we are not liable for indirect damages or data loss. Mandatory consumer rights are unaffected.

8. Termination

You can delete your account at any time in the app (Profile → Delete account). We may suspend your access if you breach these terms.

9. Governing law

Swiss law applies, excluding its conflict-of-law rules. If you are a consumer, the mandatory rules of your country of residence still apply.

10. Additional terms for Apple devices

For the iOS version, the following also applies:

This agreement is between you and the developer, not Apple. The developer alone is responsible for Sponti and its content.
You receive a non-transferable licence to use the app on Apple-branded devices that you own or control, subject to the Usage Rules of the App Store Terms of Service.
Apple has no obligation to provide maintenance or support.
If the app fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price. Beyond that, Apple has no warranty obligation — any further claims are the developer's responsibility.
Claims relating to product liability, regulatory non-compliance, consumer protection, privacy, or third-party intellectual property infringement are the developer's responsibility, not Apple's.
You represent that you are not located in a country subject to a U.S. embargo and are not on any U.S. government list of prohibited parties.
Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Changes

We may update these terms. Material changes will show in the date at the top of this page; continued use counts as acceptance.
